House Bill 5293 or called" The Free Parking Act of 2022" is a bill requiring malls, groceries, and other businesses to provide free parking for their customers or legitimate patrons. It was introduced by Hon. Peter B. Miguel with the perspective to remove or reduce the parking charges or fees in different public establishments. This act covers the legitimate use of parking areas in malls and shopping centers by their legitimate patrons, as specified in the Bill. Now, different questions are arising to seek clarity on this legislation act. How can an individual or a customer be considered a legitimate patron? Is it applicable to most establishments? Will it cover different groups and become applicable to the majority of consumers? These are just a few of the inquiries and concerns that seek to provide a much clearer picture of the bill.

 

According to the Bill, a legitimate patron is one who has made actual purchases or used the mall's products and services. Essentially, if you purchase anything from an establishment, you can be considered a legitimate patron. However, you can't just show the receipt for something worth just a few pesos. The Bill also states that patrons may use parking areas in shopping malls and establishments for free if they have made an aggregate minimum purchase of Php 500 and have used the parking facility for no more than two (2) hours.

 

After that’s been established, you must be a paying customer in any of the shops of the mall and have spent a total of PHP 500. You must present your receipt/s as a supporting document. The tricky part is the 2nd criterion you need to meet is you are only given a maximum of 2 hours to get free parking. Though, we’ve read the entire Bill document, we are still curious as to what happens if a customer exceeds 2 hours despite meeting the minimum purchase amount because there are no provisions stated.

 

 

How will it affect business owners, malls, and other similar establishments?

As a way to balance the cost of providing free parking spaces against the loss of income from parking fees, tax benefits will be made available to mall owners and other business owners once it becomes law.

 

 

The Potential of the House Bill 5292 Free Parking Space Act

Truly, it is evident that the bill still needs a lot of work. Also, there is no information about the penalties for private or public establishments that fail to comply with this act, should it become law. According to Section 6 of House Bill 5292, mall and shopping establishment owners who violate these provisions will be penalized. However, there is nothing else stated, so it is unclear just how they will be penalized. But whatever the case may be, at least it's already in place.
